RENTAL TERMS & AGREEMENT

DEPOSIT – We require a 10% deposit to reserve our products. This deposit is refundable if the reservation is cancelled 31 days or more from your scheduled event. Anything less than that will result in either a credit or a complete forfeit based on our cancellation policy.

PAYMENT – Your final amount is due before the day of delivery. When our driver arrives, if you have not already settled the bill, you should expect to pay the balance before the unit ever comes off the trailer. Since your deposit was made with a card, it can easily be charged upon arrival for the balance. Should you decide to pay cash, our driver can handle that. We do not however, carry change, so please have the exact balance ready. Again, we will not pull any items off the trailer until the balance is settled.

TAXWe charge a 7% sales tax to all our rented items.

DELIVERY – Delivery time will be arranged with you prior to your scheduled event. We will deliver all rented items to the address specified at the time of checkout. Customer permits us to enter the property for delivery and pickup.

SETUP – Our items can only be setup on a level surface and will be placed on the specified surface you elected at the time of checkout. We will not setup on dirt, mud, sand, rocks, or a yard that is full of land mines (pet waste). We also cannot deliver inflatables if stairs are involved. Once the item(s) are on site and set up, you agree to not relocate, move, sub-lease, or rent the items to another party. Our team will ensure the items rented are in good working order, free of debris, clean, and secured properly. It is in your best interest to do the following to ensure both parties agree the units are ready for fun.

You should also be available for us to go over any additional rules and safety guidelines for your items at time of setup. Sign off will be required by you before our team leaves the premises.

PROPERTY CARE – You will be responsible for any and all damage to any of the rental equipment that was not caused by ordinary wear and tear. “Ordinary wear and tear” is the normal deterioration of the rental equipment caused by ordinary, reasonable, and proper use of the rental equipment. Our units will not be set up in the event of a predicted storm or high wind situation. You shall be liable to us for any and all damage caused which was not deemed “ordinary wear and tear.” Damage which is not “ordinary wear and tear” includes, but is not limited to, cutting or tearing of vinyl or netting, damage due to overturning, overloading, exceeding rated capacities, breakage, improper use, abuse, lack of cleaning, drying due to rain and/or not limited to sprinkler system, hoses, super soakers, etc…, contamination of or dirtying of rental equipment with non-approved items such as chemicals, food, paint, silly string, mud, clay, or other materials. Silly String causes permanent damage to the material in which inflatables are manufactured and will require a complete replacement of the rental unit. You agree to keep Silly String far from the rental items.

KEEPING IT CLEAN Upon delivery, You accept the inflatable(s) in its present state of cleanliness. To avoid a “$200 cleaning fee,” You agree to return the inflatable in like condition. 

RENTAL MALFUNCTIONS – You agree to immediately discontinue the use of rented items should it at any time become unsafe or in a state of disrepair, and will immediately (one hour or less) notify us of the facts. We agree, at our discretion, to make the items operable in a reasonable time, provide like item(s) if available, make a like item available at another time, or adjust rental charges. This provision does not relieve you from obligations of the agreement. In all events, We will not be responsible for injury or damage resulting in failure or defect of rented item.

RESERVATION LENGTH – Your reservation begins and ends at the specified time at the time of checkout. Prior to us picking up the rented items, we expect the units to be free of debris and in the same working order as it was at the time of delivery. It is important that the items be ready for pick up at the arranged time as we may have a party following your event.

OVERNIGHT RENTALSOvernight Rentals require the blower to be removed from the Inflatable device and locked up in a secure location overnight. ___________ Initials

PICKUPPickup time will be arranged with you prior to your scheduled event. We will not pickup items after dark, unless previously arranged. We reserve the right to schedule pick up the next day, if necessary. If that happens, bonus for you as you may end up with items longer than your reservation length at no cost to you!

CANCELLATION POLICY – Our cancellation policy is defined below:

  • 31+ days from your event date – We will refund any payments received including the security deposit.
  • 10-30 days from event date – We will refund any payments received less the security deposit. We will however allow you to use that security deposit as a credit towards a new reservation. That credit will expire after 1 year of it being issued.
  • 1-9 days from your event date – We will refund any payments received less your security deposit. At this point your security deposit will be forfeited to The Bounce House Heroes.
  • 0 days from your event date – If a cancellation occurs at the time of delivery, we are on site with the items you rented, an additional $50.00 will be added to the security deposit for inconveniencing our staff.

Weather related cancellations are the only exceptions where a 100% refund may be honored regardless of when the cancellation is made. Storms and High winds will be assessed the day of the event (no later than 8:00AM) and cancellations and refunds will be communicated. If light rain is in the forecast (30% chance or less) and you choose NOT to go through with the rental, we will allow you to use your security deposit as a credit towards a new reservation. That credit will expire after 1 year of it being issued.

WARRANTIES – We make no warranty of any kind, either expressed or implied, as to the condition of or performance of any leased equipment and You agree to immediately cease use of the equipment and contact us if any of the equipment appears to not be working properly. You agree to use the equipment at your own risk.

ACCIDENTAL DAMAGE WAIVER – We provide the option to purchase the “Accidental Damage Waiver” at the time of checkout for an additional $32 dollars. You must select this coverage prior to delivery day and must have signed all contracts and agreements in order for this to be bound. Acceptance of a claim is based on the sole discretion of The Bounce House Heroes.

This waiver covers the following:

  • Up to $250 per contract for accidental damage to the unit
  • Up to $500 per contract for reasonable wear and tear to the unit
  • Up to $1,000 per contract for pop up wind or storm damage while the unit is/was properly deflated.

This waiver is not liability insurance.

This does not cover equipment that turns up missing.

This does not cover theft, vandalism, silly string, misuse, and/or abuse.

ASSUMPTION OF RISKYou understand and acknowledge that the items rented could bring known, unknown, and unanticipated risks to you and your guests. Those risks include, but are not limited to, falling, slipping, crashing and/or colliding, injury, illness, disease, emotional distress, property damage, and even death. You and your guests, including minors, willingly assume the risks associated with the participation of the rented items.

HOLD HARMLESS LIABILITY RELEASE – You agree to compensate and hold us harmless from any and all claims, actions, suits, proceedings, costs, expenses, fees, damages, and liabilities, including, but not limited to, reasonable attorney’s fees and costs, arising by reason of injury, damage, or death to persons or property, in connection with or resulting from the use of the rented equipment. This includes, but is not limited to, the manufacture, selection, delivery, possession, use, operation, or return of the equipment. You hereby release and hold harmless us from injuries or damages incurred as a result of the use of the rented equipment. We cannot, under any circumstances, be held liable for injuries as a result of inappropriate use, God, nature, or other conditions beyond its control or knowledge. You also agree to compensate and hold harmless The Bounce House Heroes from any loss, damage, theft or destruction of the equipment during the term of the lease and any extensions thereof.

COMPLIANCE WITH LAWS – You are solely responsible for obtaining any and all permits or licenses from the appropriate government agencies prior to use. You agree not to use, or allow anyone to use, the rental equipment for any illegal purpose or in any illegal/unsafe manner. You agree to comply with all municipal, county, state, federal, quasi-govemmental laws, ordinances, and/or regulations which may apply to the use of our rental equipment. You also agree to pay all licenses, fines, fees, permits, or taxes arising from use of the rental equipment.

BREACH | INDEMNITY | ARBITRATIONIf a breach to this agreement occurs by you, the customer, You will pay for all consequential damages and further compensate The Bounce House Heroes for all costs incurred including any incurred costs required in enforcing the terms of the rental or in defending any claim or lawsuit that may arise. If we determine, within our own discretion, that you have failed, in any way, to observe or comply with the conditions of this lease, we may exercise any of the following remedies: termination of this agreement; reenter property and retake the equipment; declare any outstanding rent and charges immediately due and payable as well as initiate whatever legal proceedings necessary to recover equipment or monies; and/or pursue any additional remedies available it by law.

SEVERABILITYIf any of the terms or conditions of this Agreement are found to be unenforceable, illegal, or unreasonable by a court of competent jurisdiction, such item shall be removed from this Agreement, and the remaining terms and conditions of this agreement will stay in effect.

CUSTOMER ACKNOWLEDGEMENT – You certify that you were given ample time and opportunity to review the this agreement. You also certify that you fully understand the contents of this agreement. You also agree to be bound to all the terms and conditions set forth in this agreement.

ENTIRE AGREEMENTThis Agreement is the full agreement between you and The Bounce House Heroes. Any prior agreements, must be written, signed, and included in these terms for them to take effect. This is the entire agreement.
